Article 1 (Purpose)
These Terms set out the rights and obligations between Fairrium (the “Company”), which operates GenToon, and the members who join the GenToon Creator Program (the “Program”; such members, “Creators”). Through the Program, the Company shares with Creators part of the revenue it actually receives from cheer items bought by readers and from advertising in the community screens of the mobile app. Where these Terms provide differently from the Terms of Service or the Credit Policy about the Program, these Terms apply, and anything not covered here is governed by the GenToon Terms of Service, the Credit Policy and the Privacy Policy.
Article 2 (Definitions)
- A “cheer” means a member buying a cheer item sold by the Company (a credit gift item) and sending it to a Creator's work or series. A cheer is a sale by the Company, not money sent by the member to the Creator.
- “Net receipts” means the amount the Company actually receives for a cheer payment, minus app store commission, payment processing fees and value-added tax.
- “Earnings” means the amounts recorded as the Creator's share under these Terms (cheer earnings and the ad revenue share).
- A “qualified read” means a read by a real reader that meets the criteria set by the Company. It excludes the Creator's own reads and reads produced by improper means.
- A “hold period” means the period after earnings are recorded during which they wait to become available, given the possibility of refunds or cancelled payments.
Article 3 (Joining and Receiving Cheers)
- A member joins the Program by agreeing to these Terms in the Creator Hub or on the cheer settings screen. For a period, the Company may limit participation to some members to keep the service stable.
- To receive cheers, a Creator must be 19 or older, confirm that, and turn on cheers themselves. The Company never turns on cheers on a Creator's behalf. A Creator can turn cheers off at any time, after which no new cheers are received.
- A Creator in the Program chooses how to receive cheers. The default is “as earnings”, and a change applies to cheers paid after the change. Cheers received by members who have not joined the Program are handled in the same way as “as credits”.
- As credits: the Creator receives the credits shown on the cheer item. The cheer is then handled exactly like a credit gift from one member to another, under the gift credit rules of the Terms of Service and the Credit Policy in force at the time, and no earnings arise under these Terms.
- As earnings: the Creator receives cheer earnings under Article 4. To prevent abuse the Company may set criteria such as account age; cheers received while a Creator does not meet them are handled in the same way as “as credits”. The Company posts the criteria in the Creator Hub.
- The Company may restrict participation if a Creator breaches Article 9 or is restricted under the Terms of Service.
Article 4 (Cheer Earnings)
- Where a Creator has chosen “as earnings”, the Company pays that Creator, out of its own revenue, 70% of the net receipts of cheers sent to them as cheer earnings, or a higher rate if the Company posts one in the Creator Hub.
- Cheer earnings are recorded after the Company confirms the net receipts of the payment, and the Company never pays more than it actually received.
- Cheer earnings are a payment by the Company under these Terms, not a transaction between the cheering member and the Creator. Refunds and cancellations of cheer items follow the Terms of Service and the Credit Policy.
Article 5 (Ad Revenue Share)
- Each month the Company shares a rate it sets of the revenue it has actually confirmed and received from ads in the community screens of the mobile app with Creators who meet the eligibility criteria (partner eligibility) posted in the Creator Hub. The rate and criteria are posted in the Creator Hub.
- The ad revenue share is calculated from each Creator's share of qualified reads in that month, not from ad impressions, clicks or views. To prevent abuse, the Company may not disclose the detailed criteria for counting reads.
- A reader watching a rewarded ad is not a way to give money to a Creator. Credits or cheer stickers that readers receive from rewarded ads do not become a Creator's earnings.
- Amounts that an ad platform withholds or claws back from the Company, for example for invalid traffic, are not shared.
- Website ad revenue is not included in the ad revenue share unless the Company announces otherwise in the Creator Hub.
Article 6 (Holds and Cancellations)
- Earnings are shown as “pending” when recorded and become “available” after the hold period. The Company posts the hold period for each payment method in the Creator Hub, and it never exceeds 120 days from the payment date. For payments with a hold period shorter than 120 days, the Company may additionally hold up to 20% of the earnings as a reserve until 120 days from the payment date.
- If a cheer payment is refunded or cancelled, or the Company returns or does not receive the money because of a chargeback, payment fraud or the like, the earnings from that cheer are cancelled. If they were already paid out, the amount is deducted from the reserve and from later earnings.
- The ad revenue share becomes available after the Company confirms that month's ad revenue and publishes the allocation.
- The Company does not guarantee any level of earnings.
Article 7 (Receiving Earnings)
- Available earnings can be received as follows.
- Converting to credits: at any time, immediately, at the conversion rate and bonus the Company posts in the Creator Hub. These credits cannot be refunded, exchanged for cash or transferred to another member, and earnings converted to credits cannot be turned back into earnings.
- Bank payout in Korea: for individuals living in the Republic of Korea who are 19 or older, and for Korean businesses, on request; the Company pays on a set day each month. The minimum request amount is posted in the Creator Hub.
- Cash payouts outside Korea: the Company opens cash payouts for Creators living outside the Republic of Korea country by country, once it has a payout method and tax handling for that country. Until then, Creators can convert earnings to credits or keep them. The Company shows in the Creator Hub how Creators in each country can receive earnings. U.S. persons for U.S. tax purposes can receive credits only until the Company has U.S. tax handling in place, and Creators in countries where the Company cannot make payments because of law or sanctions can receive credits only.
- The payout bank account must be in the Creator's own name (or, for a business, the business's name). Before the first bank transfer the Company checks that the account holder matches the legal name, and cash payouts may be held for 7 days after the account is changed.
- If a bank returns a transfer, that amount becomes available earnings again.
Article 8 (Taxes)
- Earnings paid to individual Creators living in the Republic of Korea are income whether converted to credits or paid in cash, so the Company withholds tax under the Korean Income Tax Act (currently 3.3% as business income: 3% income tax and 0.3% local income tax, or as changed by law or classification), pays the remainder and files payment statements with the National Tax Service. When earnings are converted to credits, the earnings net of the tax withheld are converted.
- For this, the Company collects the legal name and resident registration number when a Creator first converts earnings to credits or asks for a bank payout (see Section 24 of the Privacy Policy).
- Business Creators may settle in the way the Company sets (such as a tax invoice).
- Where Korean law or the law of the Creator's country requires withholding on earnings paid to Creators living outside the Republic of Korea, the Company pays after deducting that tax.
- Creators are responsible for their own tax filings on the earnings they receive. The Company shows the tax withheld in the Creator Hub.
Article 9 (Prohibited Conduct and Measures)
- Creators must not:
- cheer themselves from their own or related accounts;
- ask for cheers or reads in exchange for something of value;
- ask or pay others to view or click ads;
- inflate reads by automated means or multiple accounts;
- have others use someone else's payment method, or trade cheers like cash.
- If a breach is confirmed, the Company may hold or cancel the related earnings, deduct or reclaim amounts already paid, and suspend participation, and it will tell the Creator why and accept an objection. The Company may treat cheers between accounts that share a device, network details or payment method as credits rather than earnings, or block them.
Article 10 (Creators under 19)
Members under 19 cannot receive cheers and cannot receive earnings in cash. Members aged 14 to 18 who receive an ad revenue share receive it as credits only. People under 14 cannot sign up for GenToon.
Article 11 (Leaving the Program and Unpaid Earnings)
- A Creator can turn off cheers or leave the Program at any time. Earnings already available can still be received under Article 7, and pending earnings can be received as their hold periods end.
- After account deletion the Company remains obliged to pay available earnings, and the Creator (or their heir) can request payment at service@gentoon.ai, unless the statutory limitation period has expired.
- If the Company ends the Program, it gives 30 days' notice and pays the earnings recorded up to the end under these Terms.
Article 12 (Changes to These Terms)
- The Company announces changes in the Creator Hub and on this page at least 30 days before they apply if they are unfavourable to Creators, and at least 7 days before otherwise.
- A change that lowers the cheer earnings rate, the ad revenue share rate or the credit conversion bonus is announced at least 30 days before it applies under paragraph 1. A lower cheer earnings rate applies to cheers paid from the date it applies, a lower ad revenue share rate applies to ad revenue shares calculated on or after that date, and a lower conversion bonus applies to conversions to credits made from that date. Earnings already recorded are not changed.
- A Creator who does not agree to a change may leave the Program before it applies.
Article 13 (Governing Law and Disputes)
These Terms are governed by the laws of the Republic of Korea, and disputes are resolved under the dispute resolution provisions of the GenToon Terms of Service.
Addendum
